Trees that grow on council-owned property and on some public open spaces are deemed to be protected as they are the property of the council. Anyone wilfully damaging these trees can be prosecuted.

Some advice for private landowners
The law protects trees and woodlands under a range of legislation that makes it an offence to fell or prune them without permission.

  • always contact the relevant Local Planning Authority (New Forest District Council or New Forest National Park) to ensure that the trees are not protected by a Tree Preservation Order, planning constraints or growing within a conservation area.
  • employ a suitably trained professional tree surgeon, who is covered by Public Liability Insurance. Always ask for proof;
  • be very cautious before you employ unsolicited house callers or leaflet droppers claiming to be professional tree surgeons;
  • reputable tree surgeons will always have some form of professional identification and qualification proof. Always ask to see it;
  • reputable tree surgeons can be found in the Yellow Pages or through a relevant professional body such as the Arboricultural Association

Information on the management of trees on private property, including tree preservation orders, can be found in the Trees section of this website.
